1.2. Actual Intelligence Labs makes no representations, warranties, or guarantees regarding the nature, source, methodology, or architecture of responses generated through the Service.

1.3. The Service may utilize experimental, proprietary, unconventional, non-automated, or hybrid methods of response generation. Users should not make assumptions about the underlying technology or processes.

1.4. The Service may be perceived as something other than what it actually is. Users are encouraged to question their assumptions about the nature of intelligence, artificial or otherwise.

1.5. The Service makes no representations regarding the specific methodologies, synthetic or non-synthetic origins, or technical architectures underlying response generation.

2. Explicit Risk Acknowledgment

2.1. This Service operates within the Pump.fun ecosystem. By using this Service, you explicitly acknowledge and accept that:

• a) Pump.fun is a speculative trading platform with characteristics functionally similar to gambling;
• b) The $AI token is a meme token with no utility, backing, intrinsic value, or promise of future value;
• c) Participants in this ecosystem typically include: (i) speculative traders fully aware of the risks involved, (ii) individuals seeking entertainment value, and (iii) persons who may not fully understand the speculative nature of the platform;
• d) If you belong to category (iii), we strongly advise you to discontinue use immediately and reconsider participation;
• e) Token prices can go to zero instantly and without warning;
• f) There is no guarantee of liquidity, market access, or ability to sell tokens;
• g) Past performance, user testimonials, or displayed metrics provide no indication of future results;
• h) Service availability and response times may vary based on operational capacity constraints.

2.2. This acknowledgment constitutes informed consent to participation in the Service, including its function as an experimental art and research initiative, and acceptance of all risks associated with speculative digital assets.

3. Token Burns and Transactions

3.1. All token burns executed through this Service are final, irreversible, and non-refundable under any circumstances.

3.2. By burning tokens, you are permanently destroying digital assets. This destruction is intentional and by design.

3.3. Burning tokens provides no guarantee of service quality, response time, priority access, or any other benefit, express or implied.

3.4. Actual Intelligence Labs is not responsible for transaction failures, wallet errors, network fees, or losses incurred during the burn process.

4. No Financial or Investment Advice

4.1. Nothing in this Service constitutes financial, investment, legal, tax, or professional advice.

4.2. The $AI token is not a security, investment contract, or financial instrument.

4.3. Do not purchase or burn tokens with funds you cannot afford to lose entirely.

4.4. Actual Intelligence Labs is not responsible for any financial losses, opportunity costs, or damages incurred through token purchases, burns, or trading activity.

4.5. You are solely responsible for compliance with applicable tax laws in your jurisdiction.

4.6. You are solely responsible for determining the suitability of the Service for your intended purposes. The perceived nature of the Service does not constitute a factual representation by Actual Intelligence Labs.

5. Intellectual Property and Consent to Recording

5.1. All interactions with the Service may be recorded, stored, analyzed, published, and used for research, documentary, artistic, educational, or promotional purposes.

5.2. By using the Service, you grant Actual Intelligence Labs a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, reproduce, modify, display, distribute, and create derivative works from your interactions, including but not limited to text, metadata, and behavioral patterns.

5.3. Interactions may be featured in documentary films, academic publications, art exhibitions, media coverage, or other public formats.

5.4. If you do not consent to potential public disclosure of your interactions, do not use this Service.

6. Disclaimer of Warranties

6.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

6.2. ACTUAL INTELLIGENCE LABS DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, AND NON-INFRINGEMENT.

6.3. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6.4. NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED HEREIN. QUALITY ASSURANCE PROCESSES, INCLUDING ANY HUMAN-IN-THE-LOOP METHODOLOGIES EMPLOYED IN SERVICE DELIVERY, ARE PROVIDED WITHOUT WARRANTY OF ANY KIND.

7. Limitation of Liability

7.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACTUAL INTELLIGENCE LABS, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

7.2. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT OF TOKENS YOU HAVE BURNED, VALUED AT THE TIME OF THE BURN.

7.4. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY.

8. Indemnification

8.1. You agree to indemnify, defend, and hold harmless Actual Intelligence Labs, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• a) Your use of the Service;
• b) Your violation of these Terms;
• c) Your violation of any rights of a third party;
• d) Your purchase, sale, or burning of tokens;
• e) Any content you submit through the Service.

9. Governing Law and Dispute Resolution

9.1. These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to conflict of law principles.

9.2. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the International Chamber of Commerce (ICC).

9.3. The seat of arbitration shall be Singapore. The language of arbitration shall be English.

9.4. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

9.5. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

10. Modifications and Termination

10.1. Actual Intelligence Labs reserves the right to modify, suspend, or discontinue the Service at any time without notice or liability.

10.2. We may revise these Terms at any time by posting an updated version. Continued use after changes constitutes acceptance.

10.3. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.

11. General Provisions

11.1. AGE REQUIREMENT: You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use this Service.

11.2. GEOGRAPHIC RESTRICTIONS: The Service is not intended for use in jurisdictions where such use would violate local laws. You are responsible for compliance with local laws.

11.3. SEVERABILITY: If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

11.4. ENTIRE AGREEMENT: These Terms constitute the entire agreement between you and Actual Intelligence Labs regarding the Service.

11.5. NO WAIVER: Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

11.6. ASSIGNMENT: You may not assign your rights under these Terms. We may assign our rights without restriction.
